1. Acceptance of Terms

By downloading, installing, or using Clear Days ("the App"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years of age (or the applicable minimum age in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement. If you are under the age of 18, you should review these Terms with a parent or guardian before using the App.

3. Not Medical or Professional Advice

Clear Days is not a medical device, clinical tool, or substitute for professional medical advice, diagnosis, or treatment. The App is intended for informational and personal tracking purposes only. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition or substance use disorder.

If you are experiencing a medical emergency or mental health crisis, please contact emergency services (911) or the 988 Suicide & Crisis Lifeline immediately.

4. Crisis Resources

5. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You are solely responsible for the accuracy of any data you enter and for keeping your device secure. You may not:

  • Use the App in any way that violates applicable law or regulation.
  • Attempt to reverse-engineer, decompile, or disassemble the App.
  • Use the App to develop a competing product or service.
  • Remove, alter, or obscure any copyright or proprietary notices.

6. Data & Your Device

We do not have access to your data and cannot recover it if your device is lost, damaged, or if the App is deleted. You are responsible for backing up any data you wish to preserve using the App's export feature.

7. Intellectual Property

The App, including its design, code, graphics, logos, icons, and content, is the property of the developer and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, IF ANY.

10. Indemnification

You agree to indemnify, defend, and hold harmless the developer and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the App or your violation of these Terms.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your use of the App at any time by deleting it from your device. Upon termination, all provisions of these Terms that by their nature should survive will survive, including warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

13. Third-Party Platform Terms

If you downloaded the App from a third-party platform (such as the Apple App Store or Google Play Store), you acknowledge and agree that:

  • These Terms are between you and the developer only, not the platform provider.
  • The platform provider has no obligation to provide maintenance or support for the App.
  • In the event of any failure of the App to conform to an applicable warranty, you may notify the platform provider for a refund of the purchase price (if any); the platform provider has no other warranty obligation with respect to the App.
  • The platform provider is not responsible for any claims relating to the App, including product liability, consumer protection, or intellectual property claims.
  • The platform provider and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the App and supersede all prior agreements, understandings, and communications. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

16. Changes to These Terms

We may update these Terms of Use from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of the App after changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
